RELEASE OF LIABILITY, WAIVER OF CLAIMS,
ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY. BY PURCHASING A TICKET OR ENTERING THE PROPERTY, YOU ARE AGREEING TO THIS LEGALLY BINDING WAIVER. THIS EVENT IS FOR INDIVIDUALS 18 YEARS OF AGE AND OLDER ONLY.
1. Voluntary Participation & Assumption of Risk
I understand that Wildin Out on Wheels may include physically and mentally demanding activities, including but not limited to skateboarding on wooden and concrete ramps, camping, hiking, walking, dancing, swimming, attending live music performances, and other recreational activities. I acknowledge that participation involves inherent risks of injury, illness, permanent disability, or death. I voluntarily participate and assume all risks, known and unknown, associated with these activities.
2. Declaration of Physical and Mental Fitness
I affirm that I am in good physical and mental health and have no condition that would impair my ability to safely participate in the Event. I understand that I may consult a medical or other professional before or during the Event regarding any health concerns or limitations. I voluntarily accept full responsibility for monitoring my health and well-being throughout the Event.
3. Environmental and Location Risks
I understand that the Event takes place on a rural property with varied and potentially hazardous natural and manmade features, including but not limited to uneven terrain, rocks, slippery wooden surfaces, decomposed granite flooring, wildlife (including snakes), natural bodies of water, construction materials, and other environmental hazards. I accept full responsibility for my safety and for exercising caution in this setting.
4. Substance Use Policy
I acknowledge that illegal substances are strictly prohibited on the property. Possession or use of such substances will result in immediate removal from the Event without refund.
Additionally, for the safety of all participants, alcohol or any intoxicating substances may not be consumed before or during skating or while using any skate ramps, bowls, or similar features. I agree to refrain from skating while under the influence of alcohol or other impairing substances and understand that failure to comply may result in loss of skating privileges or removal from the Event.
5. Right to Deny or Terminate Access
I understand that Event organizers and property staff reserve the right to deny or revoke access to any individual at any time, without explanation, for reasons including but not limited to safety concerns, disruptive behavior, intoxication, or violation of Event rules. No refund will be issued in such cases.
6. Medical Treatment Consent
In the event of injury or illness, I authorize the Event organizers or their representatives to seek emergency medical treatment on my behalf. I understand I am responsible for any costs associated with such treatment.
7. Media Release
I acknowledge that photographs and videos may be taken during the Event. I grant permission for my image, voice, and likeness to be used for marketing, promotional, or commercial purposes, in any medium, without compensation or need for further approval.
8. Release of Liability
I hereby release, waive, discharge, and hold harmless Jammalynn Flower LLC, the property owners, Event staff, volunteers, vendors, sponsors, performers, contractors, and affiliates (“Released Parties”) from any and all liability, claims, demands, or causes of action that may arise from my participation in the Event, including those arising from the negligence of the Released Parties.
This release and waiver do not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that cannot be released by agreement under California law.
9. Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all liability, damages, losses, claims, demands, actions, or expenses (including attorney's fees) arising from my participation in the Event.
10. Refund Policy Acknowledgment
I understand that cancellations made within 7 days of the Event start date are eligible for only a 50% refund. I agree to this policy and accept the financial risk associated with late cancellation.
11. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved exclusively in the courts of San Luis Obispo County, California. I agree to personal jurisdiction in the courts of San Luis Obispo County, California, and waive any objections to venue.
12. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. CA Civil Code Section 1542 Waiver
I expressly waive the provisions of California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
I understand and acknowledge that by signing this Agreement, I am waiving all rights to claims or actions that I do not know or suspect to exist at the time of signing.
14. Litigation Waiver
I acknowledge that by signing this Agreement, I waive any right to file a lawsuit for any claims, including but not limited to personal injury, property damage, emotional distress, or wrongful death, arising from my participation in the Event. This waiver applies to all claims, including claims of negligence, whether foreseeable or unforeseeable, and includes any and all legal actions against the Released Parties.
15. Named Releasees
The Released Parties include Jammalynn Flower LLC, the property owners, Event staff, volunteers, vendors, sponsors, performers, contractors, agents, affiliates, and any other individuals or entities associated with the Event.
16. Age Verification
I confirm that I am at least 18 years of age and legally competent to sign this waiver. No minors are permitted to attend the Event.
BY ATTENDING THIS EVENT, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO THE TERMS OF THIS WAIVER.
